Hi Andy

We've shown all,our cards, but apart from the copy of the mortgage which dosent say much, even the mortgage amount isn't on their.
I always thought it was the bill,of sale that had the £1 and other considerations on.
But this is the copy of the mortgage, dosent say anything about the amount of money or repayments,Mathis is the auctial mortgage document.

I agree with you Alan about how and what this guy dopid or didn't do, but if you knew who he was there is no way he gave it to the company.

Hello Colin,

You do appear to have inherited a huge can of worms here! At least you have been allowed to see much of the paperwork. Do keep it all safe!
If the Director took out a marine mortgage and paid the funds into the company he then would have had a ownership of the boat and on defaulting the mortgage company would have a claim. If. however, he just pocketed the money then the mortgage would have been obtained fraudulently.

The outcome of the mortgage company investigation could be the good news for you that the hull was legally the companies and for the liquidator to dispose of. However - do consider taking some professional legal advice.

Hi Andy

Thanks for that, it's just that we bought another Dutch Barge shell, bought it from a marine boat building company, who built and owned her since 2006. The company was liquidated, split in two. All this is on google.
Got invoices, emails. Etc. But it seems as though a past director a Q/C (well known) had took a marine mortgage out on it without anyone knowing some years back. The mortgage company has since been in touch, and at the moment there investigating what's gone on.
The boat has never been finished, we bought it WITHOUT the new engine and generator that were provisioned for the boat.

I've spoken to the investigations gentleman, there's nothing like taking the boat away etc, but the mater of ownership is what I need advice on.
It seems as though the q/c took a mortgage out to raise himself money. With out the knowledge of the company over years.
It seems the bank may have been hoodwinked into giving him a mortgage, even though he didn't own the boat.
It was a ltd company's asset this is our make of the situation
The mortgage doc looks as though it hasn't been filled out as it should p, and what's writing on it is unreadable.
Nothing at the time has gone down a negative route, but feel as though we've sent all the bills and receives pages of emails we're still waiting.

Maybe we should be doing something like getting a level letter done, or would we be jumping the gun?
Would we be making a siUatiin worse! As though we have been told it will be sorted out, and not to worry.
Even I suggested do I need legal advice, it's been said don't do anything yet, as this could all been sorted with the liquidators,
Who gave the go ahead to the company to sell the boat, and the money went back to the company.
I can't say no more as I would like the league advice, which I can't afford, butaybe have to have to protect the boat from possibly being taken away, even though I've been assured this isn't going to happen.

No we don't offer free legal advice but there are two companies listed in the Suppliers guide under legal services who specialise in matters marine..

The Barge Buyers Handbook has some advice on buying a barge as does this section of the Knowledge Base

Or is there a member who is a solicitor that can offer legal advice re the purchase of a Barge please
I don't expect this for free, but idealy a solicitor who appreciates the complexity of Barge ownership.
